(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced the guilty plea of defendant Floyd McNeil after a distracted driving stop by police found him in possession of a high caliber handgun while he was out on bail on a 2019 attempted murder charge in Nassau County.
“The fact that this defendant, an alleged gang member and one that was out on bail for attempted murder charge no less, thought he could drive around in Suffolk County with a loaded handgun is beyond brazen,” said District Attorney Tierney. “This defendant is a prior violent felony offender with a dangerous criminal past. He remains in custody and will no longer pose a danger to Suffolk County residents.”
McNeil, 26, pleaded guilty to Criminal Possession of a Weapon in the Second Degree on September 29, 2022.
According to court documents and the defendant’s statements, on January 25, 2022 at approximately 12:13 p.m. McNeil was observed by members of the Suffolk County Police Department operating a 2015 Honda Accord on Straight Path in Wyandanch, while looking at his cell telephone.
A traffic stop was initiated and as officers approached McNeil’s vehicle they observed him adjusting his jacket in his chest area. As officers were speaking with McNeil he again adjusted an object underneath his jacket, appeared extremely nervous and then provided identification.
McNeil, who gave authorities a Wheatley Heights address, initially complied with the officer’s request to exit the vehicle, however, upon exiting the vehicle he immediately attempted to flee on foot. The officers caught up to McNeil, a brief struggle ensued, but he was ultimately placed in handcuffs. Once in custody, McNeil told officers he had a gun on his person. Police recovered a loaded, defaced .40 Caliber Smith & Wesson semiautomatic pistol from a fanny pack McNeil had around his chest, under his jacket.
McNeil was out on bond on a September 15, 2019 Attempted Murder indictment in Nassau County. While in custody on the Suffolk County weapons possession charge, he was indicted in Nassau County for a 2020 Murder.
McNeil is a prior violent felony offender for a March 23, 2017 conviction for two counts of Robbery in the First Degree, Criminal Possession of a Weapon in the Second Degree and Robbery in the Second Degree, for which he was sentenced to five years’ incarceration and three years post release supervision and four years’ incarceration and three years post release supervision respectively.
This case was heard before the Honorable Anthony S. Senft. McNeil is due back in court for sentencing on December 1, 2022 and he is being represented by Lane Bubka, Esq.
This case is being prosecuted by Assistant District Attorney Pamela J. Bloomfield of the Major Crime Bureau.
