Previously Convicted Felon Sentenced to 25 Years in Prison After Jury Conviction for Robbery and Assault of Amityville Business Owner

Jason Funderburke Was Found Guilty After a Jury Trial in March

(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Jason Funderburke, 39, of Hempstead, was sentenced to 25 years in prison after a jury found him guilty of Robbery in the First Degree and other related charges, for robbing and stabbing the owner of a funeral home in Amityville in August 2023.

“We will not tolerate violent attacks in Suffolk County,” said District Attorney Tierney. “This three-time convicted felon made the choice to rob and stab an owner of a funeral home, someone who serves our community during their most solemn moments. Let me be clear that we will do everything in our power to protect our citizens from violent criminals. This sentence will ensure that defendant Funderburke is no longer able to hurt our residents.”

The evidence at trial established that on August 29, 2023, at approximately 11:30 a.m., the owner of an Amityville funeral home was attempting to enter the facility when he was approached by Funderburke and an accomplice. Funderburke and the accomplice showed the victim a picture of the victim’s family and demanded money from him at knifepoint. When the victim refused, Funderburke and the accomplice attacked the victim, stabbing him twice and stealing his wallet and phones. The victim was transported to Good Samaritan University Hospital where he was treated for stab wounds and internal bleeding.

On March 12, 2025, Funderburke was convicted of the following charges after a jury trial heard before Supreme Court Justice Timothy P. Mazzei:
· One count of Robbery in the First Degree, a Class B violent felony;
· Two counts of Robbery in the Second Degree, Class C violent felonies; and
· One count of Assault in the Second Degree; a Class D violent felony.

Prior to this case, Funderburke had been previously convicted of multiple offenses, including three felonies: Criminal Sale of a Controlled Substance in the Second Degree, a Class B felony, in 2007, Robbery in the Third Degree, a Class D felony, in 2004, and Criminal Possession of a Controlled Substance in the Fifth Degree, a Class D felony, in 2004.

On April 16, 2025, Justice Mazzei sentenced Funderburke to 25 years in prison. He was represented by Chase Brown, Esq.

This case was prosecuted by Assistant District Attorneys Kieran R. Rogers and Amanda B. Scheier of the Major Crime Bureau, and the investigation was conducted by Detective Corey Malinowski of the Suffolk County Police Department’s First Squad, with assistance from District Attorney Investigator Daniel Gallagher and Research Analyst Brooke Baade of the Suffolk County District Attorney’s Office.

Criminal complaints and indictments are merely accusatory instruments. Defendants are presumed innocent until proven guilty. No one is above the law.
