(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that David Marmol was found guilty after trial for possessing narcotics and a weapon recovered as a result of a vehicle traffic stop.
“This case is a reminder of the potential dangers our police officers face when they approach a vehicle during a routine traffic stop,” said District Attorney Tierney. “The observations of the officers here, who stopped this defendant for a mere seatbelt violation, led to the recovery of a dangerous metal knuckle knife and multiple bags of cocaine, heroin and fentanyl that was packaged in a manner consistent with drug dealing. Thanks to the diligent work by those in the District Attorney’s Office as well as within the Suffolk County Police Department, this defendant was prevented from selling these deadly drugs in Suffolk County.”
On Friday, December 2, 2022, after a week-long trial, Marmol, 41, was convicted of two felony counts of Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor; and Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor. He faces a determinate sentence of between 2-12 years imprisonment upon sentencing.
The evidence at trial established that on February 20, 2021, Suffolk County Police Department uniformed officers stopped Marmol in the vicinity of South Fifth Street and Montauk Highway in Lindenhurst, for failure to wear a seatbelt while operating a rented 2020 Ford Expedition. Upon approach, the officers detected an odor of marijuana originating from inside the vehicle. During a search of the vehicle, the officers recovered an illegal metal knuckle knife from the center console. Marmol was arrested and transported to the First Precinct, where upon further search, he was found to possess 20 bags of cocaine collectively weighing in excess of one half ounce. Also recovered from the defendant were an additional four bags containing quantities of heroin and fentanyl.
Marmol was previously convicted of Attempted Criminal Possession of a Controlled Substance in the Fifth Degree in 2010; Robbery in the Second Degree in 2001; and Criminal Sale of a Controlled Substance in the Fifth Degree in 2000.
The trial was heard before Supreme Court Justice, the Honorable Timothy P. Mazzei. Marmol is represented by Michael Brown, Esq. He is due back in court for sentencing on January 31, 2023.
The case is being prosecuted by Assistant District Attorney Dennis Wouters of the Narcotics Bureau.
