Massapequa Man Indicted for Raping and Robbing a 12-Year-Old Boy

Marquise Utsey Allegedly Went to the Boy’s Home After Connecting with Him on a Mobile Application

(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Marquise Utsey, 34, of Massapequa, was indicted for Rape and Robbery for allegedly raping a 12-year-old boy after connecting with him on a social networking and dating mobile application.

“The conduct alleged in this indictment reflects utterly reprehensible behavior and a profound betrayal of basic human decency,” said District Attorney Tierney. “The defendant was a complete stranger who allegedly used a mobile app to gain access to a child for his own sick benefit. Our office will hold anyone who exploits technology to prey on children fully accountable. We will pursue justice aggressively to protect our community and its most vulnerable members.”

According to the investigation, in the late evening of December 6, 2025, Utsey allegedly went to the 12-year-old victim’s house while his parents were not home. While inside the home, the defendant allegedly raped the child before demanding that the child give him money. Fearing for his own safety, the victim went into a family member’s bedroom and allegedly gave Utsey the money that he found there. Utsey then left the victim’s house. When his parents arrived back home, he told his parents what happened. They called the police and soon located Utsey, placing him under arrest.

On December 23, 2025, Utsey was arraigned on the indictment before Acting Supreme Court Justice Karen M. Wilutis for:
· Two counts of Rape in the First Degree, Class B violent felonies;
· Two counts of Sexual Abuse in the First Degree, Class D violent felonies;
· One count of Robbery in the Third Degree, a Class D violent felony; and
· One count of Endangering the Welfare of a Child, a Class A misdemeanor.

Justice Wilutis ordered Utsey held on $750,000 cash, $1.5 million bond, or $7.5 million partially secured bond during the pendency of the case. Utsey is due back in court on February 3, 2026, and faces 25 years in prison if convicted on the top count. He is represented by the Legal Aid Society of Suffolk County.

This case is being prosecuted by Assistant District Attorney Johanna Poremba of the Child Abuse and Domestic Violence Bureau, and the investigation was conducted by Detectives Lisa Hofelich and Jacob Alerte of the Suffolk County Police Department Special Victims Section.

Criminal complaints and indictments are merely accusatory instruments. Defendants are presumed innocent until proven guilty. No one is above the law.
