Central Islip Man Sentenced to 10 Years in Prison for Sexually Abusing Child

Elmer Martinez Will Continue to be Supervised by Parole for 10 Years After His Release from Prison

(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Elmer Martinez, 44, of Central Islip, was sentenced to 10 years in prison followed by 10 years of post-release supervision after he pleaded guilty last month to repeated acts of sexual abuse, including sexual intercourse, with a child beginning when the victim was 10 years old.

“It is imperative that children feel safe coming forward to report sexual abuse,” said District Attorney Tierney. “This defendant thought the child would not say anything because the child was vulnerable and scared, but she displayed tremendous bravery in reporting the truth. Now it is the defendant’s turn to face the consequences for his actions.”

According to the investigation and the defendant’s admissions during his guilty plea allocution, in the fall of 2014, when the victim was 10 years old, Martinez began touching the victims’ intimate parts. As time went on, Martinez’s conduct escalated to acts of sexual intercourse. Martinez threatened the child in an attempt to prevent her from disclosing the abuse. The defendant continued exploiting and abusing the victim until March 2020. A few months later, the victim reported the abuse to police despite the fear she felt as a result of Martinez’s threats.

On March 17, 2023, Martinez pleaded guilty before County Court Judge, the Honorable Judge Karen M. Wilutis, to Course of Sexual Conduct Against a Child in the First Degree, a Class B violent felony. On April 12, 2023, Martinez was sentenced to 10 years in prison followed by 10 years of post-release supervision. He was represented by Christopher Gioe, Esq.

This case was prosecuted by Assistant District Attorney Tara Laterza of the Child Abuse and Domestic Violence Bureau.

Criminal complaints and indictments are merely accusatory instruments. Defendants are presumed innocent until proven guilty. No one is above the law.
