Brookhaven Man Indicted for Criminal Sexual Acts and Promoting a Sexual Performance by a Child

Dylan Pace, Previously Charged on a 50-Count Indictment for Promoting a Sexual Performance by a Child, Now Faces Criminal Sex Act and Endangering the Welfare of a Child Allegations

(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Dylan Pace, 32, of Brookhaven, was indicted for Criminal Sexual Act and Endangering the Welfare of a Child, for the 2016 alleged sexual abuse of a then 14-year-old boy that he met through an adult dating app.

“The exploitation of children is among the most serious crimes we prosecute,” said District Attorney Tierney. “The numerous allegations put forth in these indictments are truly disturbing. Our office remains committed to protecting children and holding alleged predators accountable.”

According to the investigation, in 2016, Pace, then 22, allegedly met the then 14-year-old victim through a social networking app. Pace allegedly exchanged messages on multiple occasions with the minor and eventually is alleged to have sexually abused him. During the alleged conversations with the victim, Pace is also accused of threatening to contact the boy’s parents and expose his sexual identity if he did not send nude photos of himself. The child allegedly first reported the abuse to the National Center for Missing and Exploited Children, who notified local law enforcement.

On September 11, 2025, Pace was arraigned on the current indictment before Acting Supreme Court Justice Karen M. Wilutis for nine counts of Criminal Sexual Act in the second Degree, Class D violent felonies, and two counts of Endangering the Welfare of a Child, Class A misdemeanors.

Justice Wilutis ordered Pace held on $500,000 cash, $2,500,000 million bond, or $5,000,000 million partially secured bond. Pace is due back in court on September 29, 2025, and faces 7 years in prison on each D Felony, if convicted on the top counts. He is being represented by Robert Macedonio, Esq.

Pace was previously indicted in August for 25 counts of Promoting a Sexual Performance by a Child, Class D felonies, 25 counts of Possessing a Sexual Performance by a Child, a Class E felony, and Tampering with Physical Evidence, a Class E felony. In that case, between November 2024 and February 2025, the National Center for Missing and Exploited Children received 13 tips that child sexual abuse material had been downloaded at the home where Pace resides.  During the execution of search warrants for Pace’s electronic devices, the defendant allegedly threw his phone out the window to prevent Suffolk County Police Department Digital Forensics Unit officers from recovering it. Digital forensic analysis of Pace’s devices allegedly led to the recovery of thousands of images and videos of child sexual abuse material. He was arrested on August 25, 2025, and later indicted by a Grand Jury on charges related to the child sexual abuse material, but posted bond and had been out of jail until his rearrest on September 10, 2025.

This case is being prosecuted by Assistant District Attorney Breanna McIntyre of the Child Abuse and Domestic Violence Bureau, and the investigation was conducted by Detective Joseph Gonzales of the Suffolk County Police Department Digital Forensics Unit.

Criminal complaints and indictments are merely accusatory instruments. Defendants are presumed innocent until proven guilty. No one is above the law.
